Terms of Service
Last updated: 18 September 2026
1. Overview
Vitelar ("we", "us", "our") designs and builds websites and web applications, either as a one-time project or as a managed monthly subscription. By placing an order, submitting a quote request, or creating an account, you agree to these Terms.
2. Orders and quotations
Fixed-price packages are purchased directly through checkout. Larger or more complex projects are quoted individually after you submit your requirements; work only begins once you accept a quotation and payment is received. Each order is assigned a unique reference number for tracking.
3. Payment
Payments are processed securely through Stripe. We do not store your card details. Prices are shown in US dollars (USD) or British pounds (GBP) depending on your location, and you are charged in the currency displayed at checkout (you can switch currency from the site header). Custom quotations are issued in USD unless stated otherwise. Prices are due in full before work begins, unless a different payment schedule has been agreed in writing.
4. Revisions and delivery
Each package specifies the number of revision rounds included, if any. Deliverables are reviewed internally for quality before being sent to you. Turnaround times are estimates and begin once we have everything needed to start the work.
5. Your content and files
You retain ownership of any files, materials, or instructions you provide. You are responsible for ensuring you have the right to share anything you upload with us.
6. Intellectual property in deliverables
For one-time (fixed-price or custom-quoted) orders: unless otherwise agreed in writing, ownership of the final deliverable transfers to you upon full payment. We may retain internal working copies for quality assurance and support purposes.
6a. Website-as-a-Service: ownership and cancellation
Some website packages are billed as a recurring subscription ("Website-as-a-Service" or "WaaS") rather than a one-time fee. Because the site is built, hosted, and maintained as part of an ongoing service, ownership works differently from a one-time order:
- While your subscription is active, you have full use of the site and its content, and we handle hosting, updates, and agreed maintenance as part of the plan.
- Ownership of the site design, code, and content transfers to you once your subscription has been active for the minimum term stated in your order (or immediately, if no minimum term applies to your plan). Until that point, the site remains our property and is licensed to you for use only while the subscription is current.
- Domain names you purchase yourself remain yours at all times. If we purchased or registered the domain on your behalf, we will transfer it to you on request once any outstanding balance is settled.
- Cancellation can be requested at any time through your dashboard or by emailing hello@vitelar.com, effective at the end of the current billing period — we don't charge cancellation fees. If ownership has already transferred to you under the previous point, cancelling stops hosting and support but does not affect your ownership of the site.
- If you cancel before ownership has transferred, we will provide an export of your site's content and a reasonable handover period (at least 14 days) to migrate to a new host before access is withdrawn, unless the subscription was cancelled for non-payment.
- Non-payment: if a subscription payment fails and isn't resolved within 14 days, we may suspend the site and, after 30 days of continued non-payment, cancel the subscription and remove the hosted site, subject to the export/handover period above.
7. Cancellations and refunds
One-time orders: you may request cancellation before work has started for a full refund. Once work has begun, refunds are considered case by case based on work completed.
Subscriptions (including Website-as-a-Service): see section 6a above for cancellation, ownership, and data-handover terms specific to recurring plans.
Contact us through your dashboard or at hello@vitelar.com to discuss a specific order or subscription.
8. Limitation of liability
Our liability for any claim relating to an order is limited to the amount paid for that order. We are not liable for indirect or consequential losses.
9. Changes to these terms
We may update these Terms from time to time. Continued use of the service after an update constitutes acceptance of the revised Terms.
